Terms of Trading

We are Howard Handling, a company trading from Units 10 & 11 Bridgwater Court, Oldmixon Crescent, Weston- super-Mare BS24 9AY. When you (the person named on the order) place an order with us, our business together is conducted under the following Trading Terms and in conjunction with our Standard Terms & Conditions and Privacy Policy.

1. Prices
We offer goods for sale through our website www.howardhandling.co.uk, our catalogue, other promotional materials (printed and electronic) and our trade office. Our prices vary from time to time. Print & e-promotions such as catalogues, advertisements and flyers will display a date when the advertised pricing is valid from and a date when the advertised pricing ends. During the valid period of a catalogue or promotion, we may offer goods and/or services at a lower price. This could be a special offer or a price cut. Our website will always show one price. The prices we quote always exclude UK VAT and delivery. If you wish to order a product via our website and click the “buy now” link (next to the product), all applicable delivery and VAT charges will be displayed on the following PayPal Checkout pages.

2. Payment
All goods are offered to you on a payment with order basis. We use PayPal to take and process your credit/debit card payments, and your card details are never seen or stored by us. For information regarding the encryption and security used by PayPal, please refer to PayPal’s Privacy Policy and Terms of Use. All major credit and debit cards are accepted.

Alternatively you can make payment by bank transfer or cheque (or cash at our trade office). Please contact us to request our details for making a bank transfer payment, or to pay by cheque. Goods will only be dispatched if your order is accompanied by payment in full and on receipt of cleared funds into our bank account. Credit accounts are offered solely at our discretion and are subject to completion of a Credit Account Application Form, a credit check and suitable trade references. Please refer to our Standard Terms & Conditions for credit account conditions and terms of payment.

3. Dispatch
We will normally dispatch your goods within 48 hours of your order/payment, unless otherwise specified on your quotation/order confirmation. Goods remain the property of Howard Handling until paid for in full.

4. Delivery
We will deliver your order to any UK mainland business address. Our standard delivery uses a national carrier, or for larger items, a pallet delivery company. In most cases, you will receive your goods within 3 working days. If your address is off the beaten track, or the carrier finds your address more difficult to find, your delivery may take a little longer. For Northern Ireland or more remote areas such as the Scottish Highlands & Islands, an additional delivery cost may be applicable and delivery can take several days: please contact us to confirm the delivery cost and estimated delivery date before placing your order. If you require a sooner delivery or special delivery instructions (eg before 12pm or delivery via a tail lift vehicle), this should be requested and availability confirmed with you before you place your order. Availability of faster or special delivery services depends on where you are, and in some cases, the time of day that your order is placed. When we use third party carriers, we cannot be held responsible for carrier delays that are outside of our control.

5. Receiving Orders
Unless we have your written permission, we will require an authorised signature when delivering goods to you.

6. Availability
We aim to keep sufficient stock of commonly ordered items and popular products, so that we do not run out. However on occasion (eg due to unexpectedly high demand), we may unfortunately run out. If this happens we may delay dispatch of your order for a couple of days while new stock is obtained. If dispatch time is longer, we will inform you. If you have opted for a non-standard delivery option, or we are expecting a longer delay, we will use the information you have provided to keep you informed of progress. You may contact us at any time to check on the progress of your order.

7. Cancellation
If you wish to cancel your order, you may do so at any time prior to dispatch, unless otherwise stated in your quotation/order confirmation. If you wish to cancel an order, you should do so in writing by email, or by telephone. We are unable to cancel orders and/or issue refunds for goods which have been specially ordered (non-stock items) or have been specially made.

8. Warranty
If any of the goods we supply fails to perform satisfactorily, please contact us as soon as possible via email or telephone. Wherever possible, we will send one of our trained engineers to your location to carry out an examination of the goods. If we agree that there is a warranty claim, we will carry out any repairs on site, or arrange for the goods to be repaired at our engineering workshop and return the goods to you in as short a time as possible. If any fault is found to be due to an issue not covered by warranty (eg damage or wear and tear), we will send you a written quotation for the repair. We are not liable for any other losses due to product failure. Unless otherwise stated in your quotation/order confirmation, the warranty period for parts and new equipment shall be 1 year or 500 hours (whichever is soonest) from date of delivery.

9. Mistakes
We make every effort to ensure that the prices, specifications and other information listed on our website, quotations and other literature are accurate. Nevertheless, human errors can and do occur. There may be circumstances where it is not possible for us to supply the advertised product, price and/or delivery time. In such cases we will contact you to explain the situation and try to offer you an acceptable alternative. If we are unable to resolve the matter with you, we reserve the right to refuse your order and refund any payment you have made.

10. Unforeseen Circumstances
Where things like strikes, wars, acts of terrorism, or smaller things like power cuts, interfere with our business operations, we will do our best to keep our services running. Nevertheless, we cannot accept liability for any product or service failures which are due to unforeseen circumstances, or to any other situation outside of our control.

11. Age Restrictions
Age restrictions apply to the supply of our goods and services. By ordering goods and services from us, you confirm that you are over 18 and that the person paying for, and/or receiving the delivery is also over 18.

12. Liability
Nothing in these Trading Terms affects your statutory rights or limits our liability for death, personal injury or fraudulent misrepresentation resulting from our negligence. Our liability is limited to a full refund of the goods purchased. We will not compensate for delivery delays or failures and our liability to you will be limited to a refund of the delivery charges you have paid. Our liability to you specifically excludes compensation for indirect or consequential loss or damage, however it arises, and except as described above will always be limited to a refund of your payment.

13. Law
These terms of business will be interpreted and adjudicated under English law.
